THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.  DO NOT ENTER THIS CONTEST UNLESS YOU REPRESENT A NON-PROFIT ORGANIZATION REGISTERED AS A RESCUE AMBASSADOR IN THE PURINA® PRO PLAN® RALLY TO RESCUE® AMBASSADOR PROGRAM AND ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

The Purina® Pro Plan® Rally to Rescue® “Doing More™ for Pets” Rescue Stories Contest ("Contest") starts at noon Central Time (CT) on Tuesday, March 2nd, 2010 and ends at 11:59:59 A.M. CT on Friday, October 1st, 2010. Entries may be submitted from noon CT on Tuesday, March 2, 2010 until 11:59:59 A.M. CT on Friday, April 23, 2010. ELIGIBILITY: This Contest is offered only to non-profit organizations registered in one or more of the 50 United States and/or the District of Columbia that have registered as Rescue Ambassadors in the Purina® Pro Plan® Rally to Rescue® Ambassador Program by March 2, 2010.  All federal, state and local laws and regulations apply to the Contest. Void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement to these Official Contest Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER:   Entries consist of two parts: 1) a written essay describing how, within the past two years, the Rescue Ambassador rescued a dog or cat, cared for the animal, and prepared it for adoption, and 2) a photograph of the featured pet after the pet responded to proper care. Essay must be 250 words or less and written in English.  NOTE: An “at time of rescue” photo, if available, may also be submitted.  However, this “before” photo is not required for entry and will not be considered in the judging process.  There are two ways to enter: 1) Enter electronically by emailing DMFPcontest@mbsassoc.com.   The e-mail entry must contain a) the name, mailing address and daytime phone number of the Rescue Ambassador submitting the entry,
b)  a contact name for the Rescue Ambassador, and c) the name and address of the owner of the dog or cat featured in the essay/photograph, if the dog or cat featured in the essay/photograph adopted since it was rescued,  together with your essay and photograph(s) in JPEG or GIF format.  2) Access www.RallytoRescue.org between noon CT on March 2, 2010 and 11:59:59 A.M. CT on April 23, 2010 and complete an on-line entry form.  Complete all required fields on the form and follow the instructions to upload your essay and photograph in JPEG or GIF format, then click "Submit Your Story". All entries must comply with the ENTRY REQUIREMENTS specified below.

All entries must be received by 11:59:59 A.M. CT on April 23, 2010. Limit two entries per Rescue Ambassador.  If more than two entries are submitted, only the first two entries that are posted, received and processed will be eligible.  Submission of an Entry grants Sponsor and its agents the irrevocable right to publish, use, adapt, edit and/or modify each element of such Entry in any way, in any and all media, without limitation as to time or territory, and without consideration to the entrant.  No correspondence about entries will be entered into, nor will photos or essays be acknowledged or returned. If required information is not included, entry will be disqualified.  Sponsor is not responsible for late or incomplete entries.

ENTRY REQUIREMENTS:  If the featured dog or cat has been adopted, the Rescue Ambassador must secure the current owner’s agreement to participate in the Contest by submitting the Pet Owner’s Authorization and Release form signed by the pet’s current owner. The signed Pet Owner’s Authorization and Release form must be mailed by the Rescue Ambassador to Promotion Fulfillment Center, 311 21st St. Camanche, IA 52730 for receipt by April 23, 2010.  It is not required that the featured dog or cat be adopted in order to be eligible.  Limit one cat or dog per entry/photo; photos depicting other animals or people will not be considered.  Do not include any branded products, trademarks or logos in the photos. Entries must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe third-party rights; and must be suitable for publication (i.e., may not be obscene or indecent).

Photos must be in JPEG or GIF format with picture dimensions no smaller than 800 x 600 pixels and a file size not larger than 400 kilobytes (uncompressed). Photos may be color or black and white.

ROUND ONE JUDGING: On or before April 26, 2010 the judges will select ten finalists from all eligible entries (“Finalists”).  Entries will be judged based on the following criteria: composition of the essay (20%), originality of the essay (20%), and relevance of the essay to the “Doing More™ for pets” theme (20%); quality of the photo (10%), composition of the photo (10%) and perceived health and happiness of the pet based on the appearance of the pet in the photo (20%). In the event of a tie for the 10th Finalist spot, the essay “relevance” score and then the photo “health and happiness” score will be used to determine the last Finalist. All decisions of the judges are final and binding.

FINALIST NOTIFICATION AND WINNER REQUIREMENTS: Finalists will be notified by e-mail, telephone, or postal mail on or before May 7, 2010.  As a condition of being named a Finalist, a representative of each Finalist must appear, along with their featured dog or cat, on a Nestlé Purina PetCare Company produced video which will be uploaded to the voting websites indicated below. If a Finalist is ineligible, is not willing to appear on video, or if a Finalist or pet owner fails to timely return a completed and fully executed Affidavit of Eligibility and Liability Release (as described below) their respective prizes will be forfeited and an alternate Finalist may be determined, based on the judging criteria outlined above.  All decisions of the Sponsor and PFC in this matter are final.

 

GRAND PRIZE WINNER DETERMINATION: The ten Finalist entries and video segments will be posted to the Rally to Rescue® website (www.RallytoRescue.org) and other social media sites, and will be available at Rally Across America tour stops for popular vote.  Starting at noon CT on Friday, June 4, 2010 and ending at 11:59:59 A.M. CT Friday, October 1, 2010, site and tour visitors will be invited to vote for their favorite Finalist entry.  Limit one vote per person.  If more than one vote is received per person, only the first vote submitted will count. Cookies must be enabled for Internet voting.  Internet and tour stop voting will count toward 40% of the total score assigned to each Finalist.  The remaining 60% of the total score will be assigned by one or more independent judges using the following criteria: composition of the essay (10%), originality of the essay (25%), relevance of the essay to the “Doing More™ for pets” theme (25%); and health and happiness of the pet as based on the appearance of the pet in the video segment (40%). 

Based on the combined scores of the popular vote (40%) and the independent judge(s) score (60%), one (1) Grand Prize winner will be determined. In the event of a tie, the Rescue Ambassador that submitted the story receiving the highest score in Round One Judging will be awarded the Grand Prize.

PRIZES:  One (1) Grand Prize: the winning Rescue Ambassador will receive manufacturer’s coupons good for up to $5,000 in Purina® Pro Plan® brand Pet Food. If the Grand Prize Winner’s featured pet is adopted, that pet owner will receive a one-year supply of Purina® Pro Plan® brand Pet Food for one pet.  This will be awarded in the form of manufacturer’s coupons good for the recipient’s choice of either: a) fifteen 18-lb. bags of Pro Plan® brand Dog Food (max value $509.85), OR b) fourteen 7-lb. bags of Pro Plan® brand Cat Food (max. value: $335.86).

 A designated member of the winning organization, along with the winning pet and (if adopted) the pet’s current owner, will also receive a 4-day, 3-night trip to Philadelphia,  Pennsylvania, to attend the 2010 Kennel Club of Philadelphia and National Dog Show (“Grand Prize Trip”). The Grand Prize trip includes round-trip coach airfare for one (1) member of the Rescue Ambassador organization and one (1) pet owner (if the pet is adopted), and the winning dog or cat if air travel in the cabin is possible; three nights’ hotel accommodations for each person, and ground transportation to and from the hotel.  The approximate retail value of each trip is $2,000. The stated value of this trip represents Sponsor’s best good-faith determination. Actual value depends on travel origin and airfare fluctuations and will be used for tax reporting. The Rescue Ambassador member and the pet owner are solely responsible for all other expenses not specified herein including but not limited to meals, ground transportation, and miscellaneous pet expenses.   The designated Rescue Ambassador member and pet owner must be 21 years of age or older to take the trip.  If travel with the pet in the cabin is not possible, or the pet owner would prefer to drive to the show, Sponsor will provide pet owner with $1,000 to cover travel expenses in lieu of airfare.

Nine (9) Finalist Prizes:  The remaining nine (9) Finalist organizations and the pet owner(s) (if adopted) will each receive a one-year supply of Purina® Pro Plan® brand Pet Food for one pet. Finalist prizes will be awarded in the form of manufacturer’s coupons good for the recipient’s choice of either: a) fifteen 18-lb. bags of Pro Plan® brand Dog Food (max value $509.85), OR b) fourteen 7-lb. bags of Pro Plan® brand Cat Food (max. value: $335.86). Limit one (1) Finalist prize per Rescue Ambassador and pet owner. There will be no prize substitution or exchange except at the sole discretion of the Sponsor.  All applicable taxes and expenses related to the acceptance and use of a prize are the responsibility of the winner.

All applicable Federal, state and local taxes, are solely the responsibility of the Finalist and Grand Prize winners.

AFFIDAVITS: As a condition of being awarded a prize, all potential Finalists and corresponding pet owners will be required to execute, and deliver to Sponsor within seven (7) days of notification, an Affidavit of Eligibility and, Publicity Release and  Release of Liability. Potential Finalists are subject to verification by Sponsor or Administrator, whose decisions are final and binding in all matters related to the Contest. A potential Finalist is not a winner of any prize unless and until that potential Finalist’s eligibility has been verified and potential Finalist has been notified that verification is complete. Except where prohibited by law, acceptance of a prize constitutes permission to use the name of the Rescue Ambassador organization, the name, biographical information, and likeness of the representative of the Rescue Ambassador and pet owner, and submitted photographs and essays for purposes of advertising and promotion in all media, including on-line worldwide, without limitation or further compensation.

RELEASES AND GENERAL CONDITIONS: By entering the Contest, participants agree: (a) to be bound by these Official Contest Rules and the decisions of the Sponsor and PFC, which shall be final and binding, and (b) that the Sponsor, its parent companies, their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with the Contest, whether caused by Website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Contest; (2) any errors, omissions, interruptions, deletions, defects, delays in operation, or unauthorized access to the Website or in any materials associated with the Contest; (3) any injury, damage, or loss to participants' or any other person's computer related to or resulting from participating in this Contest or downloading materials from, or otherwise using, the Website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Contest; (6) garbled, incomplete, damaged, misdirected, late, lost, undelivered, or unprocessed entries; (7) any condition caused by events beyond the control of the Sponsor which may cause the Contest to be disrupted or corrupted; or (8) any loss, injury or damage of any kind caused by participation in this Contest, or by the acceptance and/or use of any prize.  Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of this Contest should fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Contest.

Sponsor assumes no responsibility for any third party's failure to act in accordance with Sponsor's instructions pertaining to the implementation of this Contest.

By entering this Contest the Rescue Ambassador gives its consent for Sponsor to deliver the entry material and personal information of any Rescue Ambassador Representative to PFC and/or other Contest administrators as required for the purpose of administering the Contest.  Only Sponsor, PFC and such other Contest administrators will have access to the personal information.  Information will be used in accordance with Sponsor's online privacy policy.  For information regarding Sponsor's online privacy policy go to www.purina.com and click on "Privacy Policy".

WHO WON:  Finalist names will be available at www.RallytoRescue.org between June 4, 2010 and October 1, 2010.  The Grand Prize winner’s name will be posted to this site on or around December 1, 2010.
